Terms of Service

1. Acceptance of Terms

By creating an account or using JobSucks ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts. By using the Platform, you represent that you meet these requirements.

3. Account Types & Responsibilities

3.1 Business Accounts

  • You may post jobs, review bids, hire freelancers, and manage projects
  • You are responsible for providing clear and accurate job descriptions
  • You agree to pay freelancers promptly upon satisfactory completion of work
  • Job postings must not contain discriminatory, illegal, or misleading content

3.2 Freelancer Accounts

  • You may browse jobs, submit bids, communicate with businesses, and deliver work
  • You are responsible for the quality and timeliness of your deliverables
  • Your profile information, skills, and portfolio must be accurate and truthful
  • You operate as an independent contractor, not an employee of JobSucks

4. Platform Rules

All users agree to:

  • Maintain the confidentiality of their account credentials
  • Not create multiple accounts for deceptive purposes
  • Not engage in spam, harassment, or abusive behavior
  • Not use the Platform for illegal activities or to post prohibited content
  • Not circumvent the Platform's payment or communication systems
  • Comply with all applicable laws and regulations

5. Bidding & Hiring

Submitting a bid is a non-binding expression of interest. A binding agreement is formed only when a business accepts a freelancer's bid. Both parties are then expected to fulfill their obligations as described in the job posting and bid proposal.

6. Escrow & Milestone Payments

JobSucks uses a secure milestone-based escrow system to protect both parties:

  • Funding: Businesses fund specific project milestones before work begins. These funds are held securely in escrow by the Platform.
  • Milestones: Projects should be broken into clear deliverables. Payment is released upon milestone approval.
  • Submission: Freelancers submit work deliverables through the Platform for business review.
  • Release: Businesses must release escrowed funds within 7 days of satisfactory work delivery.
  • Service Fees: Platform service fees are deducted from the escrowed amount upon release to the freelancer.

7. Dispute Resolution

While we encourage direct resolution, our formal dispute system is available for contested milestones:

  • Initiation: Either party can raise a dispute on an active job with evidence.
  • Mediation: Our support team will review provided evidence (messages, files, milestones) to reach a fair resolution.
  • Decisions: Platform decisions are final and binding. This may result in partial refunds or full releases.
  • Communication: Only on-platform communication is considered during dispute mediation.

8. Intellectual Property

Unless otherwise agreed in writing, intellectual property rights for work delivered through the Platform transfer to the business upon full payment. Freelancers retain the right to showcase completed work in their portfolios unless the business explicitly restricts this.

9. Reviews & Ratings

Users may leave honest reviews after project completion. Reviews must be truthful, relevant, and non-defamatory. JobSucks reserves the right to remove reviews that violate these guidelines.

10. Limitation of Liability

JobSucks provides a marketplace platform and does not guarantee the quality of work, the solvency of users, or the outcome of any transaction. We are not liable for:

  • Disputes between businesses and freelancers
  • Loss of data, revenue, or business opportunities
  • Content posted by users on the Platform
  • Service interruptions beyond our reasonable control

11. Account Suspension & Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm the Platform community. Users may delete their accounts at any time through their profile settings.

12. Modifications

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or platform notification.
